TERMS & CONDITIONS

1. Scope of Work
SwiftServe IT (“we”, “our”) will provide IT services, which may include project-based work, operational support, or consulting. The scope will be agreed in writing before work commences.

2. Rates and Fees
Services are charged at either:

    1. a fixed agreed price for the defined scope; or
    2. an hourly rate as advised.
    3. Where unforeseen circumstances or additional requirements arise, we will notify you promptly and such work will be charged at the applicable hourly rate unless otherwise agreed.

3. Estimates and Variations
Any estimates provided are indicative only and subject to change. If the scope changes, we will confirm the revised estimate or seek written approval for variations before proceeding.

4. Payment Terms
Invoices are issued upon completion of work, or periodically for ongoing services. Payment is due within 7 days of invoice date unless otherwise agreed. Late payments may incur interest at 2% per month and/or suspension of services.

5. Customer Responsibilities
You agree to:

    1. Provide timely access to premises, systems, and information as needed.
    2. Maintain adequate data backups before work begins.
    3. Ensure all required licences, consents, and approvals are in place.

6. Liability
We will use reasonable skill and care in providing services. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential loss, including loss of data, revenue, or business. Our total liability is limited to the amount paid for the specific service giving rise to the claim.

7. Warranty
We warrant our services for 14 days from completion. This warranty covers workmanship but excludes faults caused by misuse, unauthorised changes, or third-party software/hardware failures.

8. Confidentiality
We will treat all customer information as confidential and will not disclose it to third parties except as required by law or with your consent.

9. Termination
Either party may terminate the agreement with written notice. You agree to pay for all work performed and costs incurred up to the termination date.

10. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of that jurisdiction.

Acceptance of Terms
By engaging SwiftServe IT to perform services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
